Terms of Service

1. Agreement

By creating an account on Popeki Track, you agree to these Terms of Service and our Privacy Policy. If you are using Popeki Track on behalf of a business, you represent that you have authority to bind that business to these terms.

2. What Popeki Track Does

Popeki Track is a software-as-a-service platform that provides WhatsApp ad attribution, lead classification, and marketing automation for businesses. You connect your own WhatsApp Business API account, and Popeki Track helps you track which advertisements lead to WhatsApp conversations, classify leads using AI, and send conversion data back to ad platforms.

3. Your Responsibilities

  • You must use your own WhatsApp Business API account and comply with Meta's WhatsApp Business Policy and Commerce Policy.
  • You are the data controller for all personal data processed through your Popeki Track account. You must have lawful basis (such as consent) to collect and process your contacts' data.
  • You must not use Popeki Track to send spam, unsolicited messages, or messages that violate applicable laws including GDPR, CCPA, CAN-SPAM, or local telecommunications regulations.
  • You are responsible for the content of messages sent through your WhatsApp Business API account.
  • You must keep your account credentials and WhatsApp access tokens secure.

4. Data Processing

Popeki Track acts as a data processor on your behalf. We process personal data only as necessary to provide the service.

  • WhatsApp conversation content is processed by AI providers for lead classification. This processing occurs in real time and content is not retained by AI providers beyond the API call.
  • Click tracking data (IP addresses, user agents) is collected when users click your tracked links. This data is stored in your account.
  • Conversion events are sent to Meta Conversions API only when you explicitly configure this feature. Phone numbers are SHA256-hashed before transmission.

5. Subscription and Payment

  • Paid plans are billed monthly via Stripe. Your credit card statement will show "Popeki" as the billing descriptor.
  • All plans include a 14-day free trial with up to 50 conversations. No credit card is required to start your trial.
  • You can upgrade, downgrade, or cancel at any time through the billing portal.
  • Conversation limits reset on the first day of each billing cycle.
  • Refunds are handled on a case-by-case basis. Contact us within 14 days of a charge for refund requests.
  • We reserve the right to change pricing with 30 days' notice. Existing subscriptions are honored until the next renewal.

6. Acceptable Use

You may not use Popeki Track to:
  • Violate any applicable law or regulation
  • Send unsolicited bulk messages or spam
  • Impersonate another person or business
  • Attempt to reverse-engineer, decompile, or access the source code of the platform
  • Interfere with or disrupt the service or its infrastructure
  • Resell access to Popeki Track without written agreement

7. Service Availability

We aim for high availability but do not guarantee uninterrupted service. Popeki Track depends on third-party services including Meta's WhatsApp Business API, Stripe, and cloud infrastructure providers. We are not liable for downtime caused by these third-party services.

8. Data Retention and Deletion

Your data is retained for the duration of your active account. Upon account cancellation or deletion request, we will delete your data within 30 days. Some data may be retained longer if required by law or for legitimate business purposes (such as billing records).

9. Intellectual Property

You retain all rights to your data. We retain all rights to the Popeki Track platform, including its software, design, and documentation. You are granted a non-exclusive, revocable license to use the platform for the duration of your subscription.

10. Limitation of Liability

To the maximum extent permitted by law, Popeki Track's liability is limited to the amount you paid for the service in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, including lost profits or data loss.

11. Termination

Either party may terminate this agreement at any time. You can cancel your subscription through the billing portal. We reserve the right to suspend or terminate accounts that violate these terms, with notice where reasonably possible.

12. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or in-app notification at least 14 days before they take effect. Continued use of the service after changes take effect constitutes acceptance.

13. Governing Law

These terms are governed by the laws of the State of Delaware, United States. Any disputes will be resolved in the courts of Delaware, unless local consumer protection laws provide otherwise.
